STAY OF REDIRECTION FEES
Our firm is pleased to announce that today, December 18, 2019, after an Injunction Hearing in front of Commonwealth Court President Judge Mary Hannah Levitt, the Court issued an Order whereby the Pennsylvania Department of Education agreed to refrain from issuing invoices for redirection fees, not cash checks received, and use its best efforts to return any checks and all monies paid by charter schools pending the Court’s decision on Preliminary Objections. A decision on Preliminary Objections is not anticipated until Spring of 2020.
Kevin M. McKenna, Esq., James J. Munnelly, Esq. and Carolyn N. Flynn, Esq. appeared on behalf of Pennsylvania Virtual Charter School, Agora Cyber Charter School and Pennsylvania Leadership Charter School.
This development is not only significant for the above mentioned three charter schools, but for all charter schools across the Commonwealth of Pennsylvania, as it will be universally enforced in favor of all charter schools.
