Our firm will then aptly defend litigation through the deposition of the claimant, employer, medical and vocational experts, the presentation of evidence and argument in court. When appropriate, we file Suspension, Modification, Termination, Review of Medical Treatment Petitions and Petitions to Compel IMEs and Impairment Rating Evaluations, as well as review Utilization Review Determinations.
We have also successfully engaged in both voluntary and mandatory mediation and appeals regarding medical cost containment to the Workers’ Compensation Appeal Board as well as supersedeos fund reimbursement once a determination is obtained that benefits were not payable to claimant.
We have been successful in briefing and ultimately winning a defense verdict for our clients with regard to Employee vs. Independent Contractor designations and Intervening Injuries/Causes, among other specialized issues.
In order to minimize the potential exposures of our employer clients, we can provide training in prevention of claims and review employer site protocols and concerns.
